RH već uložila 1.3 milijarde eura u BiH, a dolaze i novi projekti (Večernji list, subota, 8. srpnja 2023.)

 Republika Hrvatska uložila 1.3 milijarde eura u Bosnu i Hercegovinu, a dolaze i novi projekti. Osim političke podrške, Hrvatska je i strateški važan ekonomski saveznik BiH.

U 2022. BiH bila najveći primatelj hrvatske bilateralne pomoći s više od 40 projekata u vrijednosti od 16.7 milijuna eura. Hrvatska će svojim savjetima, ali i pozicijom i ugledom u EU, svakako ojačati perspektivu BiH za IPA projekte.
Hrvatski premijer Andrej Plenković u kontekstu gospodarstva podsjetio je na čak 4 milijarde eura vrijednu vanjskotrgovinsku razmjenu.

Mogherini i Pendeš potpisale Okvirni sporazum o učešću BiH u operacijama EU za upravljanje kriznim situacijama (15.09.2015.)

Visoka predstavnica i potpredsjednica Europske komisije Federica Mogherini i ministrica odbrane Bosne i Hercegovine (BiH), Marina Pendeš, potpisale su danas u Briselu Okvirni sporazum o učešću Bosne i Hercegovine u operacijama Europske unije za upravljanje kriznim situacijama.
Sporazumom se utvrđuje pravni okvir za moguće buduće učešće Bosne i Hercegovine u cijelom nizu vojnih operacija i civilnih misija za upravljanje krizama, koje vodi Europska unija. Nadalje, Sporazum predstavlja korak naprijed ka većoj razini strukturirane saradnje između Europske unije i Bosne i Hercegovine u oblasti sigurnosti.
Europska unija već ima bliske veze sa Bosnom i Hercegovinom u ovoj oblasti, imajući u vidu da je EUPM, kao prva policijska misija u okviru zajedničke sigurnosne i odbrambene politike Europske unije, pokrenuta u Bosni i Hercegovini 2003. godine, sa zadatkom pružanja podrške policijskim strukturama do juna 2012. godine. U zemlji je još uvijek prisutna vojna operacija Europske unije pod nazivom EUFOR Althea, koja je pokrenuta 2004. godine i koja podržava napore BiH na očuvanju sigurnog okruženja kao i propratnu izgradnju kapaciteta i obuku Ministarstva obrane BiH i Oružanih snaga BiH.
Novi okvirni instrument će omogućiti, ovisno od slučaja do slučaja, nesmetano uključivanje Bosne i Hercegovine u postojeće i buduće napore Europske unije na upravljanju krizama širom svijeta. Time će se izbjeći nepotrebna odlaganja, u slučajevima gdje je Bosna i Hercegovina pozvana i saglasna da učestvuje u operacijama Europske unije. Instrument će također ponuditi i bolju učinkovitost i fleksibilnost u odgovoru na buduće krize te dodatno potvrđuje sve veću ulogu i zalaganje BiH da djeluje kao faktor sigurnosti, posebno u svjetlu njenog trenutačnog doprinosa mirovnim operacijama UN-a.

The European Union has granted three million euros to the International Commission on Missing Persons (ICMP) under the Instrument for Pre-Accession Assistance (IPA) 2016, for a two-year project to continue helping the Bosnia and Herzegovina (BiH) authorities to locate and identify the estimated 7,000 persons who are still missing from the 1992-95 conflict.

Under the EU-funded project, ICMP, a treaty-based International organization headquartered in the Hague,  will continue to help the authorities in BIH address the interrelated issues of unidentified remains held in BiH mortuaries and misidentifications that occurred before ICMP introduced DNA testing in 2001. ICMP will maintain Forensic Anthropology and Archaeology activities and will continue to deliver DNA matching and identification. It will also seek to ensure increased use of its Online Inquiry Center (OIC) by individuals and organizations in BiH.

Previous EU funds have been a significant factor in enabling ICMP to help the authorities in BIH account for more 23,000 persons – more than 75 percent of all those who went missing during the conflict,” said the Head of ICMP’s Western Balkans program, Matthew Holliday . “However, at least 7,000 are still missing – and that’s why it is critical that continued financial support is made available so that ICMP can maintain its assistance to BiH to search for and identify the missing and fulfill the rights of the families of the missing, Holliday added”

The Head of the EU Delegation to BIH and EU Special Representative in BIH Ambassador Lars-Gunnar Wigemark, said that helping the authorities to fulfil their obligations to families of the missing is our common moral duty. It will also contribute to efforts to strengthen the rule of law, and support peace and stability in the country. “From an enlargement perspective, the ICMP project will help to address concerns that were raised in the European Commission’s 2016 BiH Country Report, which characterized the unresolved fate of missing persons as an issue of concern,” Ambassador Wigemark said.

Statement by EU Ambassador Lars-Gunnar Wigemark, following the HJPC conclusions of 26 October 2017 on the dismissal of judges and prosecutors

The European Union takes note of the conclusions adopted by the High Judicial and Prosecutorial Council (HJPC) on 26 October 2017 in connection to the information submitted by the Centre for Investigating War and War Crime and Search for Missing Persons from Republika Srpska.

Certain of the conclusions adopted by the HJPC raise concerns and could directly affect the independence of judges and prosecutors as well as the respect of the fundamental rights.

Fair trial is prerequisite for public trust in the judicial system. The presumption of innocence is at the core of the fundamental rights protected by the European Union.

No public official, including judges and prosecutors, should be dismissed without a proper independent investigation and disciplinary procedures first being applied. The appropriate sanction should only be decided after such procedures have been conducted and the allegations against the officials found to be grounded in the law. Circumventing such procedures will limit the independence and impartiality of the judiciary and is not in line with EU standards.

As recently proposed by the EU experts, there is a need to improve the criteria for appointment and dismissal of officials, in line with EU standards.

And any such improvements need to take full account of the need to maintain the independence of judiciary as well as the respect of fundamental rights.

The blog author: The statement is the reaction to
 the conclusions adopted by the BaH High Judicial and Prosecutorial Council HJPC in relation to the Information filed by Republika Srpska Center for Investigation of War, War Crimes and Search for Missing Persons. The information included the names of 9 judges and 6 prosecutors reported on the grounds of discrimination of Serbs in the war crime proceedings, as well as the documentation about their war past making them biased or discreditable for performing independent judicial or prosecutorial function.

After discussing this Information a multi-ethnic HJPC as a body in charge of appointment of judges and prosecutors in BaH decided to undertake several urgent steps including the submission of the Information and documentation to the Office of Disciplinary Prosecutor and BaH Prosecutor's Office, requesting urgent proceedings. One of the most important conclusions is related to the initiation of the procedure of amendments of the Law on HJPC to introduce an exceptional, extraordinary measure for dismissal of a judge or prosecutor without a prior disciplinary procedure. The HJPC is to prepare the contents of this provision in line with the legal standards and requirements of the European Convention on Human Rights that will be submitted as a proposal to the relevant national institutions.

Reporting about the Western Balkans Summit in Trieste, German newspaper Die Welt writes that "the EU wants to create a new mini-Yugoslavia in the Balkans."

This is according to Croatia's Index website, that said the summit brought together "the countries of the Western Balkans, as well as the leaders of Germany, France and Italy, and Croatian Prime Minister Andrej Plenkovic."

The article points out that the EU is currently not able to receive new members, and therefore wants to create a customs union in the Balkans.

According to the Croatian website, which quoted the German newspaper, "the planned Balkan customs union should be made up of Bosnia-Herzegovina, Serbia, Kosovo, Montenegro, and Macedonia, therefore all the countries created by the breakup of Yugoslavia, and possibly Albania, and the EU says that creating a common economic space would make these countries better prepared for accession - when and if it is ready to receive them."

At the same time, "the EU wants to maintain its influence in a region where major rival powers are already clashing."

"Fortunately for Slovenia and Croatia, they are already members of the EU," remarked the article.

"The goal of the customs union is to deactivate the Balkan powder keg, but without accepting these countries into the EU, with the Western Balkans being trivial for the EU, but politically speaking of central importance, especially if one knows European history. Yugoslavia kept stable that explosive mix of peoples, and now that is the task of the European Union," the German newspaper said, warning that "tensions in the region are growing."

Therefore, the EU wants to "revive the former Yugoslavia, this time as a customs and transport union, only without Croatia and Slovenia who are already in the EU."

"In such a constellation, Serbia would have the main role and all other countries would gravitate toward it - so it is not surprising that Belgrade strongly supports this European, or more precisely, German idea," the article continued.

"As Belgrade dominated in Yugoslavia, it would leave the greatest imprint on the new union," Die Welt said, adding that "Macedonia would no longer have to constantly fear for its survival because it would be part of a larger alliance, instead of alone and without defenses, surrounded by neighbors who are hostile: Greece, Albania, Bulgaria, and Serbia, who all to some degree consider Macedonia not to be a real state, some of its parts belonging to them, and Macedonians a made up people."

The article also mentions that "polls show there is regret over the dissolution of Yugoslavia in the countries of the Western Balkans with the exception of Kosovo," and it is also noted that the disappearance of Yugoslavia had created "a vacuum of power in Europe, which has not been properly filled to this day."

"Just as the collapse of the Habsburg monarchy made Europe weaker and later extradited to Hitler the newly emerged dwarf states, so the end of Yugoslavia created a permanent zone of conflict in the heart of Europe, where games of geopolitical domination are played by Russia, Turkey, the United States, Germany and other great powers," said the newspaper.

According to this, Yugoslavia disintegrated "because of the rivalry between Serbs and Croats" - but a new Western Balkan union would be "bipolar": on one hand, eight million Serbs in Serbia and Bosnia-Herzegovina, on the other, five million Albanians in Albania, Kosovo and Macedonia would "dominate the rest of the alliance."

"If all these countries created a common economic space, it would logically facilitate their accession to the EU," Die Welt believes, and recalls that the EU itself has begun "more or less" as a customs union.

On the other hand, "the relationship between Serbia and Kosovo" is described as "particularly problematic" - as Serbia considers Kosovo its own part "rather than an independent state" - and in that case, the Cypriot scenario could be repeated, says the article.

"Montenegro would have the least to gain from the Western Balkan customs union, as it has made greatest progress in its EU accession negotiations, and for it to stay in the newly created customs union would mean the greatest loss. For Kosovo, this idea, despite the domination of Belgrade, could bring the most benefits, since it is a state that is the farthest from EU membership, and this would be literally the first step in that direction," concluded the German daily.

Zakon o stvarnim pravima iz 2014. godine uveo je novinu prema kojoj stranci kao fizičke osobe mogu postati vlasnici nekretnina i to po sistemu reciprociteta. Sistem reciprociteta znači da stranci u BiH imaju ista prava kakva i državljani BiH imaju u njihovim zemljama.

S obzirom na to da bh. državljani ne mogu biti vlasnici nekretnina u Kuvajtu, tako ni Kuvajćani ne mogu biti vlasnici nekretnina u BiH. Ovu pravnu barijeru danas mnogi Kuvajćani "preskaču" tako što u BiH osnivaju firme čiji su vlasnici, pri čemu te firme, što je u skladu sa bh. zakonima, postaju vlasnici nekretnina.

Ambasada BiH u Kuvajtu i ambasador Mehmed Halilović uputili su Vladi FBiH još u martu 2016. prijedlog kojim bi se Kuvajt izuzeo iz sistema reciprociteta, a Kuvajćanima omogućilo da u BiH kupuju nekretnine uz određena ograničenja.

Ambasadu BiH u Kuvajtu jučer je posjetio i šef Delegacije EU u BiH Lars-Gunnar Wigemark te je ambasador Halilović tematizirao i ovo pitanje.

Šta je predloženo



1. Državljanima Kuvajta koji su već kupili nekretninu u BiH bi se omogućilo sticanje prava vlasništva nad nekretninom i njena uknjižba pod uslovom da uplate određeni iznos (1.000-3.000 eura) na ime kazne.

2. Da se omogući kupovina nekretnine s ograničenjem na maksimalno 5 dunuma i stambenog prostora maksimalno do 300 m2.

3. Da se uknjižba ograniči na samo jednu nekretninu i da se odgovarajućem organu uprave na tu nekretninu obavezno uplaćuje taksa u iznosu 1.000-2.000 eura na godišnjem nivou.

Ovakvom odlukom potrebno je predvidjeti i odgovarajuće mjere zaštite interesa BiH u ovoj oblasti, gdje bi se, u slučaju neizvršavanja obaveza državljana Kuvajta prema državi Bosni i Hercegovini, odredile mjere koje bi osigurale ispunjenje tih obaveza, uključujući i moguće pokretanje postupka izvlaštenja pri čemu bi se za izvlaštenu nekretninu stranom državljaninu izmirila novčana protuvrijednost nekretnine umanjena za iznos potreban za namirenje neispunjenih obaveza ili neplaćenih taksi i dažbina.

Ovim prijedlogom bi se omogućilo da se razdvoje oni koji imaju namjeru da kupe samo jednu nekretninu, od firmi koje zaista imaju namjeru da posluju. Trenutno je veliki broj firmi u BiH osnovan samo da bi se kupila jedna nekretnina.

Ambasador BiH u Kuvajtu: To je u interesu BiH



Ambasador Halilović za Klix.ba kaže da je izuzeće Kuvajta iz sistema reciprociteta interes BiH, jer bi to omogućilo značajan priliv investicija.

"Pazite, mi sada imamo bosanske firme u vlasništvu Kuvajćana koje su osnovane da bi se kupovale nekretnine. To su bosanske firme, one imaju osnivački kapital od 2.000 KM, a u vlasništvu se nekretnina koje su mnogo vrednije. Ako bi se prihvatio ovaj prijedlog, mi bismo imali značajan priliv u budžet, ti ljudi sada dolaze u BiH, a ne plaćaju nikakvu taksu. Ako bi godišnje plaćali neku taksu od npr. 1.500 eura to je značajan prihod budžeta lokalnih zajednica", kaže Halilović.

Ambasador Halilović upozorava i na različite probleme koji sada nastaju u cijelom procesu, pri čemu se prave predugovori koji Kuvajćanima omogućavaju pravo upisa vlasništva nad nekretninama, što nije u skladu sa zakonima, o čemu je Klix.ba već ranije pisao.

"Nama je u interesu da imamo što više investicija, da imamo što više novca u budžetu. Kada uporedite podatke koliko Kuvajćana je ušlo u BiH i kada vidite prihode od boravišnih taksi vidite da je to samo 20-30 posto", pojašnjava ambasador.

Za činjenicu da bi ukidanje reciprociteta u neravnopravan položaj stavilo bh. državljane u Kuvajtu i Kuvajćane u BiH Halilović kaže da se ovdje radi o ekonomskim interesima BiH.

"Svaka zemlja može da donese odluku koja je u njenom interesu. Ako govorimo o reciprocitetu, bh. državljanima trebaju vize za ulazak u Kuvajt, a Kuvajćanima ne trebaju za ulazak u BiH. Ako želimo investicije, mi moramo uskladiti naše zakone, ali istovremeno i zaštititi naš zakonodavni sistem. Ti ljudi mogu nekretnine kupovati u Španiji, Njemačkoj, Turskoj i drugim zemljama, pa zašto im ne omogućiti to i u BiH pod posebnim uvjetima? Možda ovo nije najbolji prijedlog, ali je bolji od trenutnog stanja", kaže Halilović.

Ambasador napominje da u Kuvajtu postoji veliki interes za kupovinu nekretnina u BiH, što bi za BiH moglo biti od velike koristi jer bi nekretnine gradile bh. firme, koristili bi se bh. resursi, a na kraju bi ti Kuvajćani plaćali i boravišnu taksu.
