Obraćanje visokog predstavnika Valentina Inzka Vijeću sigurnosti Ujedinjenih naroda


Gospodine predsjedniče, uvaženi članovi Vijeća sigurnosti, dame i gospodo,
Čast mi je danas biti tu kako bih informirao Vijeće o situaciji u Bosni i Hercegovini, zemlji u kojoj je posvećenost i jedinstvo međunarodne zajednice i dalje od ključnog značaja za postizanje našeg zajedničkog cilja – a on je ništa drugo do mir i sigurnost na Balkanu.
Ovi dani su posebno značajni za Bosnu i Hercegovinu koja će proslaviti dvadeset petu godišnjicu prijema u punopravno članstvo u Ujedinjenim narodima. BiH je, zajedno sa Hrvatskom i Slovenijom, primljena 22. maja 1992. godine.
Ovo je također izrazito značajan period za moju domovinu, Austriju, koja je predsjedavala Vijećem sigurnosti u mjesecu maju prije tačno 25 godina.
Tadašnji austrijski ambasador, dr. Peter Hohenfellner, u svojstvu predsjedavajućeg Vijeća sigurnosti, predložio je ovom uvaženom tijelu 20. maja 1992. godine da uputi preporuku Generalnoj skupštini za prijem Bosne i Hercegovine u UN.
Vijeće sigurnosti UN-a je na istoj sjednici jednoglasno usvojilo Rezoluciju 755 (1992) kojom je podržalo ovu preporuku.
Zahvaljujući ovoj historijskoj preporuci, Bosna i Hercegovina je 22. maja 1992. godine, Rezolucijom Generalne skupštine 46/237, prije dvadeset pet godina bez glasanja postala članica Ujedinjenih naroda.
Želim iskoristiti ovu priliku da svim srcem čestitam Bosni i Hercegovini, te izrazim zadovoljstvo što je – kako je i predskazano prije 25 godina –dala značajan doprinos radu organizacije. Posljednji primjer tog doprinosa je uspješno okončan mandat kao nestalne članice Vijeća sigurnosti UN-a, ali i učešće u mirovnim misijama širom svijeta.
Prije nego što započnem sa svojim današnjim obraćanjem, budući da mi je ovo prva prilika, želio bih također odvojiti trenutak da izrazim iskreno i duboko saučešće porodici, prijateljima i kolegama ambasadora Vitalija Ivanovnicha Churkina, koji je ostavio izrazito dubok trag u višegodišnjem radu ovog istaknutog vijeća. On je također učestvovao i u pregovorima o bivšoj Jugoslaviji kao specijalni predstavnik predsjednika Ruske Federacije.
Od mog posljednjeg obraćanja prije šest mjeseci Bosna i Hercegovina je nastavila ispunjavati obaveze koje se odnose na ostvarivanje napretka na evroatlantskom putu, dok se istovremeno i dalje suočava sa unutarnjim izazovima koji ugrožavaju održivu stabilnost i napredovanje.
Dobra vijest je da su bh. vlasti zvanično primile upitnik Evropske unije u decembru, a u istom mjesecu je okončana i adaptacija Sporazuma o stabilizaciji i pridruživanju sa EU.
Oba dostignuća sam svesrdno podržao te sam kontinuirano pozivao vlasti na svim nivoima u BiH da pažnju zadrže na evropskoj agendi.
Iskoristit ću ovu priliku i da pohvalim napore Evropske unije, pod sigurnim vodstvom specijalnog predstavnika EU Larsa Gunnara Wigemarka, na pružanju pomoći bosanskohercegovačkim vlastima u ostvarivanju svojih težnji za integraciju u EU. Jednako su značajni i napori komesara za proširenje Hahna i visoke predstavnice Frederice Mogherini, koja će sljedeće sedmice okupiti balkanske lidere na važnom regionalnom sastanku u Briselu.
Nadu također ulijeva i konsenzus te progresivni pragmatizam koji smo mogli vidjeti u periodu koji pokriva izvještaj, a koji je pokazalo Predsjedništvo BiH usvajanjem tzv. Pregleda odbrane oružanih snaga u novembru, na čije se usvajanje dugo čekalo.
To je bio jedan od zahtjeva Bosni i Hercegovini za priključivanje Akcionom planu za članstvo u NATO-u.
Na regionalnom planu imamo nastavak poboljšanja bilateralne suradnje i sveobuhvatnog pomirenja između BiH i Srbije, za šta je uvelike zaslužna predanost premijera, a uskoro predsjednika Srbije, Aleksandra Vučića, kao i napori predsjedavajućeg Vijeća ministara BiH Denisa Zvizdića.
Dobra suradnja između Sarajeva i Beograda, te između Sarajeva i Zagreba, pokazala se i kroz održavanje zajedničkih sjednica državnih vlada, te kroz posjetu premijera Hrvatske Andreja Plenkovića Mostaru.

Unatoč ovim pozitivnim primjerima, Bosna i Hercegovina se također suočila sa značajnim izazovima u proteklih šest mjeseci.
Na prvom mjestu je politički sukob bošnjačkih političkih predstavnika i srpskih političkih stranaka oko toga da li BiH treba predati zahtjev za reviziju presude Međunarodnog suda pravde iz 2007. godine po tužbi za genocid koju je BiH podnijela protiv Srbije.
Ovo pitanje je dovelo do razdora između bošnjačkih i srpskih stranaka i predstavnika u vladajućoj koaliciji na državnom nivou kakav nije viđen godinama, što je usporilo napredak.
Tenzije unutar Predsjedništva dodatno su pojačane zbog nemogućnosti postizanja dogovora oko dviju oprečnih pravnih interpretacija da li Predsjedništvo BiH mora obnoviti mandat agenta Bosne i Hercegovine pred Sudom prije nego se podnese takav zahtjev.
Sada već bivši agent BiH pred Međunarodnim sudom pravde Sakib Softić predao je zahtjev za reviziju. Uslijedile su još veće kontroverze kada je izašlo na vidjelo da je Softića sud već ranije obavijestio da ga vlasti BiH moraju ponovo imenovati kao agenta.
Ova situacija je naposljetku razriješena kada je sud odlučio odbaciti zahtjev kao nedopušten. Međutim, cjelokupna dinamika u kojoj se vodeći političari nesrazmjerno bave pitanjima koja izazivaju međunacionalni razdor, dok istovremeno ne posvećuju dovoljno pažnje stvarnim reformama, izaziva ozbiljnu zabrinutost.
Drugi negativni trend u periodu koji pokriva izvještaj ticao se aktivnosti vlasti Republike Srpske na provedbi neustavnog referenduma, uključujući i razmetljivu proslavu 9. januara kao praznika uz učešće pojedinih srpskih pripadnika Oružanih snaga BiH.
Nadalje, u periodu koji pokriva izvještaj pojedini hrvatski političari su intenzivirali zagovaranje „federalizacije“ Bosne i Hercegovine, što po nekima implicira dalju etničku podjelu zemlje na tri ili četiri „federalne jedinice“ od kojih bi jedna imala hrvatsku većinu.
Vlasti u Bosni i Hercegovini sve više pokazuju nesposobnost da djeluju čak i u vlastitom interesu, u situacijama u kojima nema gubitnika, kao što je ispunjavanje zadataka iz aranžmana koji je Međunarodni monetarni fond (MMF) zaključio sa BiH.
Zbog kontinuirane nemogućnosti da ispuni preduvjete MMF-a za kompletiranje prvog kvartalnog pregleda, zemlja će ostati bez značajne međunarodne pomoći namijenjene za fiskalnu stabilnost i ekonomski razvoj.
U tom pogledu, želim pohvaliti i podržati rad Francisca Parodija, rezidentnog predstavnika MMF-a za BiH, zbog kontinuiranih napora MMF-a na promicanju svrsishodnih strukturalnih reformi u BiH.
Situacija se nastavila pogoršavati i kada je u pitanju vladavina prava. Korupcija predstavlja ozbiljan problem. Stalna osporavanja institucija na državnom nivou, kao što su Ustavni sud BiH i Sud BiH, doprinose daljem slabljenju vladavine prava.
Na kraju, u proteklih šest mjeseci je opala učestalost i intenzitet javnih istupa predsjednika RS u kojima poziva na secesiju, iako je „nezavisni status“ Republike Srpske i dalje dio zvanične platforme njegove stranke, a već ove sedmice je javno izrazio svoje ubjeđenje da će takav referendum o nezavisnosti eventualno biti i održan.
Smanjenje takve retorike uslijedilo je nakon sankcija koje se odnose na finansije i putovanja koje su predsjedniku RS izrekle Sjedinjene Države. Za mene je to potvrda da mi kao međunarodna zajednica možemo napraviti pomak onda kada smo spremni poslati snažnu poruku vlastima i liderima koji otvoreno odbacuju vladavinu prava i ponovno otvaraju rane iz prošlosti. Ta poruka je da sebe i svoje glasače vode u izolaciju.
Potpuno suprotno od retorike koja produbljuje podjele, srednjoškolci u drevnom gradu Jajcu svojom su odlučnošću i upornošću spriječili podjelu svoje škole po principu etničke segregacije, a koju su zagovarale pojedine stranke.
Iz Srebrenice nam danas dolaze jednako ohrabrujuće vijesti. Tamo su Bošnjaci i Srbi, muslimanski i pravoslavni srednjoškolci, zajedno slavili maturu. Naglasili su: „Svi smo mi ljudi. Našom zajedničkom proslavom želimo izraziti međusobno poštovanje i želju za pomirenjem. To je posljednja i najrealističnija poruka iz Srebrenice“. Oni su istaknuli jedinstvo, ljubav i zajedničku budućnost.

Što se tiče vremena koje je pred nama, naredni opći izbori u Bosni i Hercegovini bit će održani u jesen 2018. godine.
Sa okončanjem burnog perioda izazvanog krizom oko presude Međunarodnog suda pravde i proslave dana Republike Srpske, političke rasprave u BiH će se sada najvjerovatnije usredsrediti na izmjene Izbornog zakona BiH.
Za sada nema konsenzusa po ovom pitanju, koje potencijalno može dovesti do novog političkog zastoja u zemlji.
Imajući u vidu da je ostalo nekih osamnaest mjeseci do izbora, snažno pozivam sadašnje vlasti da iskoriste predstojeći period najbolje što mogu kako bi glasačima pokazali da su u stanju prevazići stvari koje su ranije izazivale podjele i provesti svrsishodne reforme koje bi popravile ekonomsku situaciju u entitetima i u cijeloj zemlji.
Na prvom mjestu trebaju biti ekonomske reforme koje traže međunarodni kreditori, kao i pitanja koja se tiču evropskih integracija, kako bi se otvorila rana mogućnost budućeg kandidatskog statusa za Bosnu i Hercegovinu.
Također očekujem od vlasti u Bosni i Hercegovini, a prije svega od stranaka koje imaju predstavnike u državnom parlamentu, da napokon riješe zakonodavni vakuum koji još od 2012. godine onemogućava građanima Mostara da biraju predstavnike na lokalnom nivou. Ovo će zahtijevati kompromis na svim stranama i spremnost da se pitanje riješi na pragmatičan način.
Naposljetku, jednostavno je neobjašnjivo da, više od sedam godina nakon što je Evropski sud za ljudska prava ocijenio sadašnji izborni sistem diskriminatornim spram pojedinaca koji ne pripadaju jednom od tri konstitutivna naroda u BiH, značajnom broju građana se još uvijek na osnovu nacionalnosti uskraćuje temeljno pravo da se kandidiraju na javne funkcije.
Bh. vlastima mora biti prioritet otklanjanje diskriminacije koja je identificirana u tzv. slučaju „Sejdić-Finci“ i drugim sličnim slučajevima.

Dame i gospodo,
prije šest mjeseci sam opisao dva paralelna trenda u Bosni i Hercegovini: pozitivni napredak u evroatlantskim integracijama, i negativna tendencija osporavanja vladavine prava te posvećenost retrogradnim pitanjima koja produbljuju podjele.
Sa kontinuiranom podrškom međunarodne zajednice, izabrani predstavnici u Bosni i Hercegovini mogu ostvariti napredak i pobrinuti se da prvi trend bude dominantan. Ali to će zahtijevati promjenu fokusa.
Međunarodna zajednica u međuvremenu treba zadržati sve raspoložive mehanizme. Trebamo imati na umu činjenicu da u BiH postoji kompleksno političko i sigurnosno okruženje u kojem negativni scenarij može vrlo brzo ugroziti Dejtonski mirovni sporazum i napredak postignut nakon Daytona.
Stoga sam uvjeren da još uvijek postoji potreba za vojnim prisustvom EU na terenu sa izvršnim vojnim mandatom, te snažno podržavam produženje mandata kada Vijeće sigurnosti bude razmatralo ovo pitanje u novembru.
EUFOR je relativno jeftina, ali neophodna investicija u mir i stabilnost na Balkanu.
Po mom mišljenju, EUFOR pruža suštinski temelj za fizičku i psihološku sigurnost koja služi kao podrška Evropskoj uniji, mom uredu i drugim međunarodnim organizacijama u ostvarivanju našeg zajedničkog cilja, a to je održivi mir i napredak za Bosnu i Hercegovinu i njene stanovnike.
Dešavanja kojima smo nedavno svjedočili u parlamentu Bivše Jugoslavenske Republike Makedonije nas podsjećaju koliko brzo jedan incident može dovesti do eskalacije u balkanskim zemljama.

Dame i gospodo,
Unatoč napretku koji je BiH ostvarila u protekle dvije godine kako bi ostvarila status kandidata za članstvo u EU, zemlja se i dalje suočava sa suštinskim izazovima.
Na pragu treće decenije provedbe mira, ne može se uzeti kao datost da Bosna i Hercegovina lagano plovi ka „mirnoj, održivoj državi nepovratno pozicioniranoj na putanji evropskih integracija“.
To će zahtijevati stalnu posvećenost i pažnju međunarodne zajednice. U tom pogledu Vam se želim zahvaliti na kontinuiranoj pažnji koju posvećujete Bosni i Hercegovini.
Međunarodna zajednica ne može napraviti promjene koje će Bosancima i Hercegovcima donijeti veći prosperitet, stabilnost i članstvo u evroatlantskim strukturama. Samo lideri i institucije to mogu uraditi.
Ali možemo – i po mom mišljenju moramo – nastaviti pružati institucionalnu podršku i viziju zasnovanu na integraciji i funkcionalnosti.
Također moramo čvrsto podržavati suverenitet i teritorijalni integritet Bosne i Hercegovine, što pruža okvir za stabilnost i poštivanje Mirovnog sporazuma.
U tom pogledu, naša predanost Bosni i Hercegovini i njenim divnim, talentiranim ljudima, ostaje nepokolebana.

Remarks by High Representative Valentin Inzko to the United Nations Security Council


Sr. Presidente, miembros distinguidos del consejo de seguridad, señorías,
Es un privilegio el estar aquí hoy para informar a este consejo sobre la situación en Bosnia y Herzegovina, un país en el cual el compromiso y la unidad de la comunidad internacional  sigue siendo crucial para alcanzar nuestro objetivo común que no es otro que una paz y seguridad sostenible en los Balcanes.
These days are special for Bosnia and Herzegovina, as it will celebrate 25 years since its admission as a full-fledged member state to the United Nations, along with Croatia and Slovenia, on 22 May 1992.
But these days are also special for my home country Austria as it was presiding the Security Council in the month of May, exactly 25 years ago.
The then Austrian Ambassador Dr. Peter Hohenfellner, as President of the Security Council, on 20 May 1992 proposed to this august body to adopt a Decision recommending to the General Assembly that Bosnia Herzegovina be admitted to the United Nations.
At the same meeting the UN Security Council unanimously adopted Resolution Nr. 755 (1992) endorsing this recommendation.
Upon this historic recommendation, Bosnia Herzegovina was admitted with General Assembly Resolution Nr. 46/237 without vote, 25 years ago, on 22 May 1992 as a member of the United Nations.
I wish to use this occasion to congratulate Bosnia Herzegovina wholeheartedly and I am very glad that – as predicted 25 years ago – Bosnia and Herzegovina has made a significant contribution to the work of the organisation, most recently with its successful tenure as a non-permanent member of the UN Security Council, but also with its peace keeping forces worldwide.
Before making my remarks today, as it is my first opportunity, I would also like to take a moment to express my sincere and heartfelt condolences to the family, friends and colleagues of Ambassador Vitaly Ivanovic Churkin, who made such a dramatic impact on the work of this esteemed Council over many years. He was also involved in the talks on former Yugoslavia as a special representative of the President of the Russian Federation.
Since I addressed this Council six months ago, Bosnia and Herzegovina has continued in its commitment to making progress along the path of Euro-Atlantic integration, while also continuing to face internal challenges to its sustainable stability and advancement.
On the positive side, BiH authorities formally received the EU Questionnaire in December and the adaptation of the Stabilization and Association Agreement with the EU took place that same month.
I wholeheartedly welcomed both developments and have consistently called upon the BiH authorities at all levels to maintain their focus on the EU agenda.
I would like to take this opportunity to commend the efforts of the EU, under the capable leadership of EUSR Lars Gunnar Wigemark, towards assisting the Bosnian authorities in achieving their aspirations for integration with the Union. Equally significant are the efforts of Enlargement Commissioner Hahn and of High Representative Frederica Mogherini, who is inviting the Balkan leaders next week to an important regional meeting in Brussels.
Equally encouraging was the consensus and forward-looking pragmatism demonstrated during the reporting period by the BiH Presidency in adopting the so-called Defense Review of military forces last November, an issue which had been outstanding for quite some time.
This is one of the requirements for Bosnia and Herzegovina in its efforts to participate in the NATO Membership Action Plan.
And on the regional level, bilateral cooperation and overall reconciliation between Bosnia and Herzegovina and Serbia has continued to improve, in large part due to the committed engagement of Serbian Prime Minister and soon to be President, Aleksandar Vucic, and also through the efforts of the BiH Council of Ministers Chair Denis Zvizdic.
Good co-operation between Sarajevo and Belgrade, and also between Sarajevo and Zagreb, has manifested itself through joint government sessions and through the visit of Croatian Prime Minister Andrej Plenkovic to Mostar.

Despite all these positive developments, Bosnia and Herzegovina also saw some significant challenges over the last six months.
First and foremost was the political controversy between Bosniak political representatives and Serb political parties over whether BiH should submit a request for revision of the International Criminal Court’s 2007 judgment in the genocide case of BiH vs. Serbia.
This issue split Bosniak and Serb parties and officials within the state-level coalition to an extent not seen for many years, delaying progress.
Two different legal interpretations on whether the BiH Presidency needed to renew the mandate of the BiH agent to the Court before submitting such a request proved to be irreconcilable, increasing tensions within the Presidency.
The now former agent of BiH to the International Court of Justice Sakib Softic submitted the request for revision to the ICJ, which later proved even more controversial when it came to light that the Court had already notified him that a re-nomination of the agent by the BiH authorities would be needed.
The situation was ultimately resolved when the Court made its decision on the non-admissibility of the request, but the overall dynamic whereby leading politicians focus disproportionately on ethnically divisive issues, while showing little urgency in addressing the need for real reforms, is a serious cause for concern.
The second negative trend during the reporting period surrounded the activities of the RS authorities to implement their unconstitutional referendum, including ostentatious celebrations of the 9 January holiday with the participation of some Serb members of the BiH Armed Forces.
In addition, during the reporting period, some Croat politicians have intensified calls for the “federalization” of BiH, which was understood by some to imply the further ethnic division of the country into three to four “federal units,” one of which would have a Croat majority.
Increasingly, the authorities in BiH appear unable to act even in their own self-interest in a win-win situation, for instance in addressing the commitments made under the International Monetary Fund’s arrangement with BiH.
The continued failure to meet the IMF prior actions for the completion of the first quarterly review will hold back significant international assistance to the country’s fiscal stability and economic development.
In this regard, I would like to express my praise and support for Francisco Parodi, IMF Resident Representative to BiH, for IMF’s ongoing efforts at encouraging meaningful structural reform in BiH.
Furthermore, the situation with regard to rule of law in the country continues to deteriorate. Corruption is a serious problem, and continued challenges to the state-level institutions, like the BiH Constitutional Court and the Court of BiH, contribute to the further weakening of the rule of law.
Finally, during the last six months, the frequency and intensity of the Republika Srpska President’s public remarks advocating for secession have lessened, although the “independent status” of the Republika Srspka remains part of his party’s official platform and only this week he publically expressed his certainty that such an independence referendum will eventually take place.
The lessening of such rhetoric follows the imposition of financial and travel sanctions against the RS President by the United States. This reaffirms to me that we as an international community can have an impact when we are ready to send a strong message to authorities and leaders who openly reject the rule of law and reopen the wounds of the past: that they are leading themselves and their constituencies into isolation.
In sharp contrast to divisive rhetoric are the efforts of high school students in the historic city of Jajce, who, with their determination and perseverance, prevented the partition of their high school, based on ethnic segregation, as planned by some political parties.
Equally encouraging is the news today from Srebrenica, where Bosniaks and Serbs, Muslim and Orthodox students, celebrated their high school graduation together. They stressed, “We are all human beings. With our common festivities we would like to demonstrate our mutual respect and will for reconciliation. This is the last and most realistic message out of Srebrenica.” They emphasized unity, love, and a common future.

Looking ahead, Bosnia and Herzegovina will have its next General Election in the Autumn of 2018.
With the difficult period surrounding the ICJ crisis and the celebration of the RS day over, political discussions in BiH will now most likely focus on amendments to the BiH Election Law.
Thus far no consensus has been reached on this issue, which has the potential to create a new political stalemate in the country.
Having in mind that some eighteen months remain before the elections, I would strongly encourage the current authorities to make the most of the forthcoming period and demonstrate to voters that they are able to look past divisive issues and deliver meaningful reforms to improve the economic situation in the entities and throughout the country.
Foremost on this list should be economic reforms demanded by the country’s international creditors, as well as EU-related issues, in order to open the early possibility of future EU candidate status for Bosnia and Herzegovina.
I also expect the authorities in BiH, foremost the parties represented in the state parliament, to finally resolve the legislative vacuum which has prevented the citizens in Mostar from electing local representatives since 2012. This will require compromise on all sides and willingness to resolve issues pragmatically.
Finally, it is simply unfathomable that more than seven years after the European Court of Human Rights ruled that the current electoral system discriminates against individuals not belonging to one of Bosnia and Herzegovina’s three constituent peoples, a considerable number of citizens are still denied the basic right to stand for public office on the basis of ethnicity.
The authorities in BiH must correct the discrimination identified in the so-called “Sejdic-Finci” and related cases as a priority.

Ladies and Gentlemen,
Six months ago I described two parallel trends in Bosnia and Herzegovina: positive advancement in Euro-Atlantic integration and a negative tendency to flaunt the rule of law and focus on divisive backward-looking issues.
With the continued support of the international community, the elected representatives in Bosnia and Herzegovina can make progress and ensure that the first trend becomes the dominant one, but they will need to refocus.
In the meantime, the International Community should retain all the instruments at hand. We need to be mindful of the fact that BiH is a complex political and security environment, where negative scenarios can quickly endanger the Dayton Peace Agreement and the progress achieved after Dayton.
For this reason, I am firmly convinced that there is still the necessity to maintain the EU military force on the ground with an executive military mandate, and I fully support its extension when the Security Council considers this issue in November.
EUFOR is a relatively inexpensive but necessary investment in peace and stability in the Balkans.
In my view, it provides an essential baseline of physical and psychological security that supports the EU, my Office and other international organizations in pursuing our common goal of sustainable peace and prosperity for BiH and its people.
Recent scenes witnessed in the parliament of the Former Yugoslav Republic of Macedonia remind us of how quickly an incident can escalate in the Balkan countries.

Ladies and Gentlemen,
Despite the progress BiH has made in the last two years in pursuit of EU candidate country status, the country still faces fundamental challenges.
As we enter the third decade of peace implementation, it cannot be assumed that BiH is on a glide path to a “peaceful, viable state irreversibly on course for European integration.”
This will require continued attention and commitment from the international community and in this regard I would like to thank you for your continued attention to Bosnia and Herzegovina.
The international community cannot deliver the changes needed to bring Bosnians and Herzegovinians greater prosperity, stability and membership in Euro-Atlantic institutions. Only the leaders and institutions can do this.
But we can – and in my view we must  – continue to offer institutional support and a vision based on integration and functionality.

Britanski list The Guardian objavio je dijelove studije koju će ovoga tjedna predstaviti ESI, u kojoj se kritizira uloga visokog predstavnika Paddyja Ashdowna, a njegove ovlasti u BiH uspoređuju s britanskom vladavinom u Indiji u 19. stoljeću.
The Guardian navodi i riječi Ashdownova glasnogovornika Juliana Braithwaita, koji je rekao da BiH nije "europski radž", navodeći da postoji dvojba oko toga.

The Guardian published parts of a study, which is to be presented by ESI this week, criticizing a role of the HighRep Paddy Ashdown and comparing his powers in BiH with the British rule in India in the 19th century.
The Guardian has also cited Ashown's spokesperson, Julian Braithwait stating that BiH is not a "European Raj", although there is a dilemma about this.

HighRep Paddy Ashdown (May, 2002 - May, 2006) decisions relating (solely) to Republika Srpska, adopted within the period from the 7th of March, 2003 to the 30th of June, 2004 under the title: "Decisions relating to individuals indicted for war crimes in the former Yugoslavia".

The above decisions were adopted in one of the following forms:
1) Orders Blocking All Bank Accounts of, held by, and/or in the name of a specified natural or legal person;
2) Decisions Suspending All Disbursements of Budgetary Itemisations for Party Funding to the SDS and Ordering the SDS to submit a Financial Plan, and
3) Decisions removing individuals from specific functions and political party duties.

Decisions on removals of individuals from specific party functions in the SDS are particularly interesting. For instance, Pantelija Curguz, Slobodan Saraba, Cvjetan Nikic and Nedjeljko Djekanovic were removed from the position of a Vice President of the SDS. Vesna Ecim-Zlojutro, Goran Popovic and several others were removed from the position of a member of the SDS Main Board.

It is questionable how many of these persons were actually related in any way to the war crimes in the former Yugoslavia.

Posebno su zanimljive odluke o smjenama lica sa partijskih funkcija unutar SDS-a. Tako su smijenjeni Pantelija Ćurguz, Slobodan Šaraba, Cvjetan Nikić i Nedjeljko Đekanović sa položaja zamjenika predsjednika SDS-a. Vesna Ećim-Zlojutro, Goran Popović i drugi su "uklonjeni" sa položaja članova Glavnog odbora SDS-a.

Vrlo je upitno koliko je ovih osoba imalo neku vezu sa ratnim zločinima u bivšoj Jugoslaviji.

Marija Taušan razgovarala sa Piterom Bas-Bekerom o zastoju u reformama visokog obrazovanja, javne uprave, RTV sistema... do kojih je došlo, jer je visoki predstavnik Švarc-Šiling htio istrajati u svojoj namjeri da ne koristi bonska ovlaštenja, odnosno da ne NAMEĆE NIKAKVA RJEŠENJA Bosni i Hercegovini, nego da sve reforme budu rezultat rada i dogovora domaćih političara.

Marija Taušan (Nezavisne Novine) talked to Peter Bas-Backer about the blockage in the reforms of high education, public administration, RTV system... that were caused, by decisiveness of the High Representative Schwartz-Schilling to persevere in his intention not to use "the Bonn powers", i.e. NOT TO IMPOSE ANY SOLUTIONS to Bosnia and Herzegovina, but to insist on the reforms as the result of the work and agreement of the local politicians.    

"Kada je visoki predstavnik Švarc-Šiling došao u BiH, imao je dvije poruke: lokalna odgovornost i da neće koristiti bonska ovlaštenja. Međutim, to nije uspjelo, jer smo imali izbore i ustavnu debatu, a to je bio težak period za takvu jednu poruku. Stranke nisu tražile jedinstvo, nego podjelu. Nadam se, kada dođe novi visoki predstavnik, da će ovi procesi koji su započeti biti stvari koje će zaista biti važne. Švarc-Šilingov metod pokazao je najslabiju tačku u društvu, pokazao je da je u nekim oblastima još teško da BiH sama ide dalje. Kada je to isplivalo na površinu, političari su sami shvatili koliko je važno da sami rade."

Reforma Ustava ne smije uticati na ostvarivanje napretka u drugim reformama koje su neophodne za napredovanje prema EU, poručuje viši zamjenik visokog predstavnika u BiH Piter Bas-Beker.
NN: Prijedlog zakona o visokom obrazovanju prošao je parlamentarnu komisiju, ali je pet srpskih i hrvatskih članova bilo uzdržano prilikom glasanja. Kakve su šanse za njegovo usvajanje?
BAS-BEKER: Mislim da je napravljen veliki korak usvajanjem ovog zakona u Komisiji. Zaista smo dugo radili, ovo je peti ili šesti nacrt. Ono što nije usaglašeno u vezi je s Agencijom za visoko obrazovanje. O tome se možda može postići saglasnost prije ljeta. Ne bismo mogli reći da je ostvarena pobjeda, ali je došlo do pomaka. Mislim da je puno bolje raspoloženje među strankama nego ranije.
NN: Šta ukoliko ovaj zakon, ipak, ponovo ne bude usvojen?
BAS-BEKER: Ne želim o tome ni razmišljati. Ali, ukoliko bi se to desilo, to bi bio veliki korak unazad i imali bismo velike probleme.
NN: Strategija za reformu javne uprave je usvojena, međutim njeno provođenje je u zastoju?
BAS-BEKER: U pravu ste. Imali smo tranzicioni period. Nismo imali koordinatora, ta osoba nije bila u potpunosti angažovana, jer se radilo na strategijama. Sada imamo novog koordinatora. U utorak smo se sastali i sada je najvažnije da se formira tim kako bismo doveli odgovarajuće profesionalce, jer se radi o veoma komplikovanim procesima. Ono što se predviđa ovom strategijom jeste da imate administrativni sistem koji može provesti reforme koje će obezbijediti da BiH krene dalje prema Evropi. Ako nemate profesionalni administrativni sistem za ono što je potrebno za Brisel i u BiH, onda imate problem s reformama. Možete usvojiti zakone o visokom obrazovanju, obligacijama, lijekovima, ali ako nemate administrativni sistem koji će obezbijediti provođenje zakona u svim oblastima, onda niste ništa uradili. Ova reforma je jedna od osnovih za BiH.
NN: Radi li se nešto na otklanjanju zastoja u reformi RTV sistema, o čemu još nije donesen zakon u parlamentu FBiH?
BAS-BEKER: Nedavno smo razgovarali s novim ministrom za komunikacije i ukazali smo mu da se radi o reformi koju treba donijeti u kratkoročnom periodu. Pokušali smo s ministrom da vidimo kako se zakon može promijeniti da bi hrvatske stranke i njihov interes bio zaštićen, s obzirom na odluku Ustavnog suda, a u pogledu funkcionisanja UO, programskih principa, predstavljanja konstitutivnih naroda u okviru odbora.
NN: Mnoge reforme zapadnu u ćorsokak zbog sporova u vezi s prenošenjem nadležnosti s jednog na drugi nivo vlasti. Da li bi bilo lakše kada bi prvo bila dogovorena promjena Ustava?
BAS-BEKER: To je vrlo komplikovano. Ustavna reforma je vrlo važna, međutim ništa nije urađeno. Situacija je bila vrlo napeta, političke stranke su cementirale stavove. Sada smo u trenutku kada je vrlo važno da političke stranke naprave izbore koji se odnose na kratkoročniji period. Dakle, moraju obezbijediti da BiH ide dalje ka EU. Potpisivanjem Sporazuma o stabilizaciji i pridruživanju BiH bi krenula ka fazi da postane kandidat za članstvo u EU, a to znači da bi na raspolaganju bila velika finansijska sredstva iz EU. Radi se o velikim iznosima koji su važni za svakog građanina i za povećanje životnog standarda. Mislim da bi političari, po prirodi stvari, trebalo da izaberu taj put. Treba da usvoje reforme koje su važne u kratkoročnom periodu koje će omogućiti potpisivanje sporazuma, a to su policijska reforma i saradnja s Haškim tribunalom, te reforma JRTV sistema, tako da Evropska komisija da savjet zemljama članicama za potpisivanje. Međutim, ako ustavna reforme odgodi ove druge važne reforme, mislim da bismo mogli imati problem. Znate koliko može trajati reforma Ustava. Treba imati na umu kratkoročni period i da se te reforme završavaju, a da se paralelno radi na reformi Ustava.
NN: Da li mislite da su nevladine organizacije previše pasivne?
BAS-BEKER: Ne slažem se s tom ocjenom. U BiH je specifična situacija kada je u pitanju civilno društvo. Rat je donio velike traume. Mislim da smo tokom prošlih izbora vidjeli pozitivnu reakciju GROZD-a. U svim područjima koja su oštećena ratom, Glamoč, Srebrenica, Drvar, vidjećete male grupe koje rade za civilno društvo.
NN: Ali, zar Vam se ne čini da one rijetko mogu izvršiti pritisak na vlasti kako bi nešto bilo promijenjeno?
BAS-BEKER: Apsolutno ste u pravu. Mislim da svi organi vlasti moraju više obratiti pažnju na civilno društvo i posjećivati mjesta kako bi vidjeli šta se dešava i čuli šta ljudi imaju da im kažu. Ovdje nedostaje povjerenja, organi vlasti imaju veliku odgovornost da grade povjerenje. Ako ministar iz jednog naroda pokazuje samo interes za svoj narod, to nije ispravno.

Odluke visokog predstavnika koje se odnose na "državne simbole, pitanja na državnom nivou i ustavna pitanja"/ HighRep decisions relating to State Symbols, State-Level Matters and Constitutional Issues

Sa dolaskom Westendorpa na položaj visokog predstavnika, krenulo se sa formalno-pravnim i faktičkim uspostavljanjem Bosne i Hercegovine, pa je tako u decembru 1997. godine on utemeljio praksu, koju će nastaviti  Petritsch i Ashdown, donošenja „odluka koje se  odnose na državne simbole, pitanja na državnom nivou i ustavna pitanja“. Većinom ovih odluka se „nameću“ određeni zakoni (Eng. impose – za prevod v. https://hr.glosbe.com/en/hr/impose).

Tako je ovim odlukama nametnut Zakon o državljanstvu BiH, zakoni o zastavi, grbu i himni BiH i pasošu. Navedenim odlukama je uspostavljena Državna granična služba, Sud BiH, Ombudsman za ljudska prava, kao i Agencija za državnu službu (na čelo koje je - također odlukom visokog predstavnika, imenovan Jakob Finci) Vijeće ministara, Komisija za reformu odbrane i Komisija za restruktuiranje policije. Odlukama su izvršena i brojna imenovanja, ali i usvojeni USTAVNI AMANDMANI u Federaciji BiH i Republici Srpskoj.

U prilogu su odluke koje su visoki predstavnici donijeli u periodu: 12/1997. do 07/2004.

Westendorp's assumption of duty of the High Representative in BiH marked the beginning of the formal and factual establishment of Bosnia and Herzegovina. In December, 1997 he introduced the practice, that would continue with Petritsch and Ashdown, of adopting „decisions relating to State Symbols, State-Level Matters and Constitutional Issues“. A majority of these decisions were adopted with the purpose of „imposing“ a specific law.

These decisions were used to impose the Law on Citizenship of BiH; laws on flag, coat-of-arms and national anthems, as well as on the travel documents/passport. By the means of the said decisions, a number of BiH-level institutions were established, such as the State Border Service, BiH Court, Human Rights Ombudsman, as well as the Civil Service Agency (by another decision of HR, Jakob Finci was appointed as the first head of the Civil Service Agency), Council of Ministers, Defense Reform Commission and Police Restructuring Commission. The decisions were also used for numerous appointments, but also  to enact Constitutional Amendments in Federation BiH and Republika Srpska.

Tokom perioda od marta, 1998. do kraja aprila, 2004. strani službenici koji su vršili funkciju visokog predstavnika u BiH, donijeli su ukupno 112 odluka o "uklanjanju" (eng. "removal") i suspenziji sa funkcije. Radi se o  Carlosu Westendorpu (1997-99.), Wolfgangu Petritschu (1999-2002.) i Paddyju Ashdownu (2002-06.). Carl Bildt koji je bio na funkciji visokog predstavnika u periodu od 1995-97. nije koristio ovo ovlaštenje.

Svim "uklonjenim" službenicima bilo je zabranjeno vršenje funkcije u stranci, ili izbor ili imenovanje na neku funkciju. Pored toga što se često koristio ovim ovlaštenjem, visoki predstavnik Paddy Ashdown je uveo praksu donošenja odluka koje su se odnosile na pojedince optužene za ratne zločine u bivšoj Jugoslaviji i koje su se odnosile isključivo na Republiku Srpsku i Vojsku Republike Srpske (nisu uključene u ovaj spisak). Period Paddyja Ashdowna će biti zapamćen kao najturbulentniji u smislu nametnutih pravnih reformi, što se može pripisati njegovom šefu odjeljenja pravne reforme, Zoranu Pajiću. Većina tzv. nacionalnih pravnih savjetnika koji su u ovom periodu radili u OHR-u na pravnim reformama, nagrađeni su za svoj trud kasnijim imenovanjima na visoke položaje u kvazi-nacionalnim tijelima ili unutar međunarodne zajednice.  U odnosu na pojedine službenike donesene su čak dvije odluke, a jedino je u odnosu na Dragana Čavića naknadno donesena odluka kojom se poništava zabrana obavljanja funkcije

During the period from March, 1998 to the end of April, 2004, a total of 112 decisions on removals and suspensions from office was passed by foreign officials appointed to the position of the High Representative in BiH - Carlos Westendorp (1997-99), Wolfgang Petritsch (1999-2002) and Paddy Ashdown (2002-06). Carl Bildt who was HR over the period 1995-97 did not use this mechanism.

All removed officials were banned from holding any party office or public elected or appointive office.
In addition to these decisions, High Representative Paddy Ashdown had a practice of passing decisions relating to individuals indicted for war crimes in the former Yugoslavia, which were related only to Republika Srpska and Army of Republika Srpska (not included in this list). The period of Paddy Ashdown will be remembered as the most turbulent in terms of imposed legal reforms, which may be attributed to his Head of the Legal Reform Department, Zoran Pajić. The majority of national legal advisors working over this period at the OHR on the legal reform were rewarded for their effort by appointment at senior positions either at the quasi-national bodies or in the international community. Several officials were removed/suspended by two decisions and only in the case of Dragan Cavic, a decision on lifting the ban imposed by the HR on his activities was passed on 30 July 1999.

Odluke visokog predstavnika o uklanjanju i suspenziji sa funkcije (1)/ HR Decisions on removals and suspensions from office (1) - March, 1998 - November, 1999

Tokom perioda od marta, 1998. do kraja aprila, 2004. strani službenici koji su vršili funkciju visokog predstavnika u BiH, donijeli su ukupno 112 odluka o "uklanjanju" (eng. "removal") i suspenziji sa funkcije. Radi se o  Carlosu Westendorpu (1997-99.), Wolfgangu Petritschu (1999-2002.) i Paddyju Ashdownu (2002-06.). Carl Bildt koji je bio na funkciji visokog predstavnika u periodu od 1995-97. nije koristio ovo ovlaštenje.
Svim "uklonjenim" službenicima bilo je zabranjeno vršenje funkcije u stranci, ili izbor ili imenovanje na neku funkciju. Pored toga što se često koristio ovim ovlaštenjem, visoki predstavnik Paddy Ashdown je uveo praksu donošenja odluka koje su se odnosile na pojedince optužene za ratne zločine u bivšoj Jugoslaviji i koje su se odnosile isključivo na Republiku Srpsku i Vojsku Republike Srpske (nisu uključene u ovaj spisak). Period Paddyja Ashdowna će biti zapamćen kao najturbulentniji u smislu nametnutih pravnih reformi, što se može pripisati njegovom šefu odjeljenja pravne reforme, Zoranu Pajiću. Većina tzv. nacionalnih pravnih savjetnika koji su u ovom periodu radili u OHR-u na pravnim reformama, nagrađeni su za svoj trud kasnijim imenovanjima na visoke položaje u kvazi-nacionalnim tijelima ili unutar međunarodne zajednice.

During the period from March, 1998 to the end of April, 2004, a total of 112 decisions on removals and suspensions from office was passed by foreign officials appointed to the position of the High Representative in BiH - Carlos Westendorp (1997-99), Wolfgang Petritsch (1999-2002) and Paddy Ashdown (2002-06). Carl Bildt who was HR over the period 1995-97 did not use this mechanism.
All removed officials were banned from holding any party office or public elected or appointive office.
In addition to these decisions, High Representative Paddy Ashdown had a practice of passing decisions relating to individuals indicted for war crimes in the former Yugoslavia, which were related only to Republika Srpska and Army of Republika Srpska (not included in this list). The period of Paddy Ashdown will be remembered as the most turbulent in terms of imposed legal reforms, which may be attributed to his Head of the Legal Reform Department, Zoran Pajić. The majority of national legal advisors working over this period at the OHR on the legal reform were rewarded for their effort by appointment at senior positions either at the quasi-national bodies or in the international community.

HAYS AND SUMKA VISIT COMMERCIAL DIVISION OF SARAJEVO MUNICIPAL COURT

SARAJEVO, September 8 (FENA) - Principal Deputy High Representative Donald Hays and USAID Mission Director Howard Sumka visited the newly established Commercial Division of the Sarajevo Municipal Court today. Ambassador Hays and Mr Sumka were briefed by President of the Court Aida Salcinovic-Kuljunain and by judges of the Commercial Division.

Hays told journalists after the meeting that progress in resolving commercial litigation represents a significant step towards creating a more favourable economic environment in BiH and attracting foreign and domestic investments.

He said that the transition towards a market economy needs to be accompanied by adequate changes in the judiciary aimed at creating institutional and legal conditions for the economic development of BiH.

USAID Mission Director Howard Sumka stressed the readiness of this agency to support the economic reconstruction and development of BiH and reminded that the implementation of the “Fostering an Investment and Lender-friendly Environment – FILE” project has been started with that objective in mind.

Sumka said that this 3-year project in the field of commercial law is aimed at creating an environment that will better protect the rights of investors and lenders in BiH.

President of the Court Aida Salcinovic-Kuljunain also underlined the importance of resolving commercial litigation more efficiently and stressed that an overall reform is needed in order to achieve international standards in this field.

She said that a massive task of clearing the backlog of commercial litigation in BiH lies ahead of the Commercial Division and expressed confidence that improvements in this area would contribute to the higher level of legal protection of citizens and businesses.

ASHDOWN: FAILURE TO FULFIL INTERNATIONAL COMMITMENTS PREVENTS INTEGRATIONS

SARAJEVO, September 8 (FENA) – There are two key obstacles on the road of BiH towards the Partnership for Peace and entering talks on the Stabilisation and Association Agreement with the EU, which are connected the to fulfilment of international commitments, High Representative Paddy Ashdown said today after returning from London and Brussels where he held talks with British Foreign Secretary Jack Straw and EU High Representative for Security and Foreign Police Javier Solana, as well as senior NATO and Council of Europe ambassadors.

Ashdown said that one of those problems lies in Banja Luka and another in the BiH Presidency.

“It would be catastrophic for BiH and extremely difficult for the RS if action is not taken soon that would guarantee cooperation with the ICTY”, Ashdown warned.

He said that there are certain signs, certain changes in tone and posture, such as the appointment of the new RS Interior Minister, but added that none of that will be important if specific action is not taken that would give guarantees to the international community on seriousness towards cooperation with the Hague.

The RS has three more moths until the new NATO summit to demonstrate cooperation, but it has already wasted time in August.

However, there is another obstacle that prevents accession to the Partnership for Peace and the SAA and it does not lie in Banja Luka, but the BiH Presidency.

Ashdown said that the issue of decertifying police has been a standing one for more than a year, but that three months have passed and the BiH Presidency has done nothing concerning the letter of the UN Security Council Chair regarding this issue.

“They have not even informed the Prime Minister or the courts about that and only yesterday was the letter with special UN instructions sent to different BiH institutions that need to implement it”, the High Representative said.

If BiH fails to fulfil its commitments as recommended by the Security Council Chair then there is no hope that BiH will be in the position to join the Partnership for Peace or enter talks on the SAA.

Ashdown thinks that it is almost scandalous that the letter of the Security Council Chair lies unopened in someone’s desk or under the carpet in the BiH Presidency instead of causing immediate action if there is to be any hope for fulfilling international commitments.

BiH PARLIAMENT - HOUSE OF PEOPLES
BiH HOUSE OF PEOPLES TO DISCUSS VAT LAW TOMORROW

SARAJEVO, September 8 (FENA) – The BiH House of Peoples will discuss the draft VAT Law tomorrow.

The broad agenda for the tomorrow’s session also includes the draft law on food, the law on technical requirements for products and the law on general safety of products.

The House of Peoples is also planned to discuss the draft law on amnesty, changes to the BiH Ombudsmen law, the law on internal debt and the law on the BiH Red Cross Association.

The draft law on the BiH customs policy, the law on monitoring and controlling crossings of the state border, the law on the State Border Service and the law on missing persons in BiH will also be on the agenda.

The House is also expected to discuss several draft laws in urgent procedure.

Due to a broad agenda the session is expected to last two days.

BiH-PRESIDENCY
BiH PRESIDENCY UNABLE TO DISCUSS SEVERAL ISSUES

SARAJEVO, September 8 (FENA) – The BiH Presidency removed several issues of its agenda today after reporters failed to appear.

“The fact that we do not have a representative of the BiH Ministry of Foreign Affairs present at the Presidency sessions is especially worrying”, BiH Presidency Chair Sulejman Tihic told journalists after the session.

Tihic said that he would send a warning to BiH Foreign Affairs Minister Mladen Ivanic because of his and the absence of his deputy Lidija Topic from the Presidency sessions, which has prevented the BiH Presidency several times from discussing issues concerning foreign policy.

He said that the Presidency has taken the issue of appointing BiH international representatives, primarily ambassadors, of the agenda for the third time.

Decisions on appointing BiH representatives to the International Civil Aviation Organisation (ICAO) and giving approval for the appointment of British and Israeli ambassadors to BiH have also been taken of the agenda.

TIHIC: PEOPLE SUCH AS MIROSLAV NIKOLIC DO NOT BELONG IN BiH

SARAJEVO, September 8 (FENA) – BiH Presidency Chair Sulejman Tihic said that the BiH Presidency did not discuss today the “chauvinist” statements by Serb Radical Party President Tomislav Nikolic.

Tihic said Nikolic’s statements at election rallies in the RS are directly inflaming national hatred and undermining the territorial integrity and sovereignty of BiH.

“I wish to say that that as far as I am concerned such individuals do not belong in BiH, especially not during the election campaign, because they do not contribute to the establishment of trust and the development of good neighbourly relations between our countries, but, unfortunately only spread national hatred between our peoples”, Tihic said.

BiH PRESIDENCY ADOPTS REPORT ON BUDGET IMPLEMENTATION

SARAJEVO, September 8 (FENA) – The BiH Presidency adopted today the report on the implementation of the BiH Presidency’s Budget for the first half of this year.

BiH Presidency Chair Sulejman Tihic told journalists that this Budget is in the region of 96,57 of approved funds.

During that period the Presidency saved significant funds thanks to the adoption of a number of books of regulations and decisions regulating the use of funds and the control of those funds, Tihic said.

Pursuant to the today’s decision of the BiH Presidency a procedure will be launched for changing the structure of expenditure. Budget control and maximal saving measures in all institutions will be introduced in cooperation with the BiH Ministry of Finance and Treasury.

OHR REMINDS THAT THE COUNCIL OF MINISTERS SUPPORTED THE VAT PROPOSAL

SARAJEVO, September 8 (FENA) – OHR stated today that the VAT rate proposed in the law is a proposal of the Indirect Taxation Administration and that it was made after serious discussions of various factors.

In a statement to FENA OHR reminded that the BiH Council of Ministers reviewed that proposal and supported it.

- This is now a matter for the BiH authorities, however, any change to the law must reflect the macroeconomic reality of this country, OHR stated.
